Can I appeal the decision if I am found not to be disabled?

Yes. If you receive a negative determination (that you do not have a disability under the 5 step process), you have the right to appeal that decision. Complete the appeals form located on the Department of Human Services web site ( and return it to your caseworker. If you have additional information you may provide it as a supplement to your appeal and it will be included in the appeal review. You have 30 days to file an appeal. SMRT will complete its appeal review and submit a memo to the hearing judge. The judge has 90 days to rule on the decision.
