What is a will?
A will is a legal document that says who should get your things after you die. It also helps your family understand what you want – giving you and them peace of mind.
What does a will do?
- Says who gets your property, money, and personal items after you die
- Names someone to be in charge of the process and follow your wishes (called an executor or personal representative)
- Says who will take care of your kids if they are under 18

What if I die without a will in Minnesota?
If you die without a will in Minnesota, state law decides who gets your things. Usually, your spouse and kids are first, and other family members are after.
Do I need a will?
Not always. Sometimes you can use other legal documents to plan what will happen to your property. Talk to an attorney to help you decide whether it makes sense to have a will or if other documents will give you the same result and peace of mind.
