CLE--Overcoming Bias: Representing Clients in End-of-Life Estate Planning, Promoting Dignity and Honoring Wishes at End of Life

This CLE will educate attorneys representing individuals with advanced cancer. In order to help clients prepare wills, Powers of Attorney, and health care directives at the end of life, attorneys must understand the challenges face by terminally ill individuals, including their physical and mental limitations.

Attorneys will learn to overcome their own biases and the biases of health care providers and family members towards individuals who may be nearing incapacity and may be extremely weak and mentally confused. Attorneys will be trained to understand the limitations of representation, learn how to understand and recognize the physical and mental changes at the of life, to recognize when capacity is present, and learn the different legal standards for capacity.

Our esteemed presenters are:

Jennifer Kuyava, MD, Hospice and Palliative Care Physician, will addressthe physical changes at end of life, including medications affecting capacity, the progression of advanced cancer, and signs of impending death

Kelly Grosklags, LICSW, BCD, Oncology Psycotherapist, will address t emotional issues at end of life, including stages of grief, dealing with family members, and respecting an individual's wishes and intentions.

Stuart Bear, Esq., Estate Planning attorney, will delve into the legal capacities required for various estate planning documents, handling challenges, protecting confidentiality when dealing with family members, addressing the "gray area" of capacity, documenting a client's mental and physical condition for potential will challenges.
