Does the termination from employment have to be involuntary?
No. As long as the employee was not terminated for gross misconduct, there is a group health plan in place, and the employee is a qualified beneficiary, then he or she is entitled to COBRA continuation coverage. It does not matter if the termination results from being laid off, being fired or the employee's decision to resign.
