Is a domestic partner a qualified beneficiary?
Under federal COBRA law, a domestic partner does not qualify as a qualified beneficiary. However, any employer may elect to include domestic partners as beneficiaries under their group health plan. If so, then the domestic partner may elect to participate in the plan and is if so chooses, is afforded all the protections as would apply to any other qualified beneficiary under the plan.
