A Health Care Directive (sometimes referred to as a “Living Will” or a “Durable Power of Attorney for Health Care”) is a document that helps those involved in your care know what your wishes are when you are not able to communicate those desires at a point in time when decisions regarding your care need to be made.

Do I need an attorney to create a Health Care Directive?

Technically, the answer is no. As long as the document contains the required elements as listed below and is properly witnessed, it will be a valid and enforceable Health Care Directive. Practically speaking, it is strongly recommended that you speak with an attorney in creating this very important document.
