Can I appeal the decision if I am found not to be disabled?
Yes. If you receive a negative determination (that you do not have a disability under the 5 step process), you have the right to appeal that decision. Complete the appeals form located on the Department of Human Services web site (www.dhs.state.mn.us) and return it to your caseworker. If you have additional information you may provide it as a supplement to your appeal and it will be included in the appeal review. You have 30 days to file an appeal. SMRT will complete its appeal review and submit a memo to the hearing judge. The judge has 90 days to rule on the decision.
