Is a Health Care Directive from another state valid in Minnesota?

If a person is receiving care in Minnesota, but has a Health Care Directive from another state, it will be deemed valid and enforceable in Minnesota if it complies with the law of the state in which it was made OR complies with the requirements for a valid Health Care Directive in Minnesota as listed above.

A Health Care Directive (sometimes referred to as a “Living Will” or a “Durable Power of Attorney for Health Care”) is a document that helps those involved in your care know what your wishes are when you are not able to communicate those desires at a point in time when decisions regarding your care need to be made.
